Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Marinsh website, mobile applications, and related services (collectively, "the Platform") operated by Marinsh Technologies (Private) Limited, a company incorporated under the Companies Act 2017 of the Islamic Republic of Pakistan ("Marinsh", "we", "us", or "our").

1. Introduction

Welcome to Marinsh — Pakistan's real estate discovery and intelligence platform. These Terms constitute a legally binding agreement between you ("User") and Marinsh Technologies (Private) Limited. Please read them carefully before using the Platform.

These Terms are governed by and construed in accordance with the laws of the Islamic Republic of Pakistan, including but not limited to the Electronic Transactions Ordinance 2002 ("ETO"), the Prevention of Electronic Crimes Act 2016 ("PECA"), and the Personal Data Protection Act 2025 ("PDPA").

2. Acceptance of Terms

By accessing or using the Platform — whether by browsing, registering an account, posting a listing, or contacting an agent — you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.

If you do not agree to these Terms, you must immediately stop using the Platform. Your continued use following any update to these Terms constitutes acceptance of the revised Terms.

3. About Our Platform

Marinsh is an online real estate listing and discovery platform. We provide a marketplace where property owners, real estate agents, and developers can post listings and where buyers, renters, and investors can search for properties across Pakistan.

Marinsh is not a real estate broker, agent, or developer. We do not hold, buy, sell, or lease any property. We do not act as an intermediary in any transaction, and we are not party to any agreement between a buyer, seller, landlord, or tenant. We provide information and tools only.

Our platform also provides indicative home loan information sourced from publicly available bank and State Bank of Pakistan data. This constitutes general information only and does not constitute financial advice.

4. Eligibility

  • You must be at least 18 years of age to use the Platform.
  • You must be a natural person, corporation, or other legal entity with the legal capacity to enter into binding contracts under Pakistani law.
  • You must not have been previously suspended or removed from the Platform by us.
  • You must not be barred from using our services under any applicable law of Pakistan or any jurisdiction to which you are subject.

By using the Platform, you represent and warrant that you meet all of the above requirements.

5. User Accounts

To post listings or contact agents you must register an account. When registering you agree to:

  • Provide accurate, current, and complete information.
  • Keep your account credentials confidential and not share them with any third party.
  • Notify us immediately at support@marinsh.com of any unauthorised use of your account.
  • Accept responsibility for all activity that occurs under your account, whether authorised by you or not.

Marinsh reserves the right to suspend or terminate any account that we reasonably believe has provided false information, violates these Terms, or poses a risk to other users or the integrity of the Platform.

6. Listings & Content

When you post a property listing, upload images, or submit any content on the Platform, you represent and warrant that:

  • The listing is accurate, truthful, and not misleading in any respect.
  • You are the legal owner of the property or are duly authorised to list it on behalf of the owner.
  • The property is legally available for sale or rent in accordance with applicable Pakistani law.
  • All photographs are of the actual property being listed and are owned by you or you have obtained the right to use them.
  • The listing does not advertise a property involved in any active legal dispute, encumbrance, or ownership fraud.

By submitting content, you grant Marinsh a non-exclusive, worldwide, royalty-free licence to use, display, reproduce, and distribute that content on the Platform and in related marketing materials. This licence ends when you delete the content, subject to cached or archived copies.

Marinsh reserves the right to remove any listing or content that, in our sole judgment, violates these Terms or applicable law, without notice and without liability to you.

7. Agent Responsibilities

Registered agents on Marinsh are required to undergo identity verification (CNIC verification) and agree to our Agent Code of Conduct. Agents must:

  • Maintain accurate profiles including valid contact information and credentials.
  • Only list properties for which they hold a valid agency mandate from the property owner.
  • Not engage in dual agency (representing both buyer and seller) without the written consent of both parties.
  • Comply with all applicable regulations including the Estate Agency Rules, 2022 (where in force in their jurisdiction).
  • Not charge buyers undisclosed fees or commissions.

Marinsh does not endorse or vouch for any individual agent's conduct outside of the Platform. Verification confirms identity only; it does not constitute a professional endorsement.

8. Property Transactions

Marinsh is a discovery platform, not a transaction platform. Any property transaction that results from a connection made on Marinsh occurs entirely outside of Marinsh and is solely between the buyer/renter and the seller/landlord (or their agent).

Marinsh has no involvement in and accepts no responsibility for:

  • The accuracy of any title deed, ownership documentation, or legal status of any listed property.
  • The completion or failure of any sale, lease, or rental transaction.
  • Any deposit, advance payment, or token money paid by a buyer or tenant.
  • Any dispute arising between a buyer, seller, tenant, landlord, or agent.
  • Any fraud, misrepresentation, or illegal conduct by any user of the Platform.

Users are strongly advised to conduct independent legal due diligence through a qualified Pakistani property lawyer before paying any money or signing any agreement.

9. Intellectual Property

All rights in and to the Marinsh brand, logo, software, website design, database structure, and original content (excluding user-submitted listings) are the exclusive property of Marinsh Technologies (Private) Limited and are protected under the Copyright Ordinance 1962 of Pakistan and applicable international treaties.

You may not copy, reproduce, scrape, distribute, modify, or create derivative works from any part of the Platform without our prior written consent. Automated scraping, crawling, or data harvesting of the Platform is strictly prohibited and may constitute an offence under PECA 2016.

10. Prohibited Conduct

You agree that you will not use the Platform to:

  • Post false, fraudulent, or misleading listings or information.
  • Impersonate any person, agent, developer, or entity.
  • Solicit usernames, passwords, or personal data from other users.
  • Transmit any unsolicited commercial communications (spam).
  • Upload viruses, malware, or any code designed to disrupt or damage the Platform.
  • Attempt to gain unauthorised access to any part of the Platform or its underlying systems.
  • Engage in any activity that violates PECA 2016 or any other Pakistani law.
  • Use the Platform for money laundering, hawala transactions, or any purpose that violates the Anti-Money Laundering Act 2010 of Pakistan.
  • Discriminate against any user based on religion, ethnicity, gender, or disability in violation of applicable Pakistani law.
  • Systematically scrape, copy, or re-publish listing data for any commercial purpose.

Violations may result in immediate account termination and referral to the Federal Investigation Agency (FIA) Cyber Crime Wing where required by law.

11. Disclaimer of Warranties

THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Marinsh does not warrant that: (a) the Platform will be uninterrupted, error-free, or secure; (b) any information on the Platform is accurate, complete, or current; (c) results obtained from using the Platform will meet your requirements; or (d) any defects will be corrected.

Property valuations, market data, and loan calculators on the Platform are indicative estimates only and should not be relied upon for financial or legal decisions.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE PAKISTANI LAW, MARINSH AND ITS DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM OR IN CONNECTION WITH YOUR USE OF THE PLATFORM, INCLUDING BUT NOT LIMITED TO:

  • Loss of money, property, or any financial investment.
  • Loss of data or goodwill.
  • Fraudulent transactions carried out by third parties.
  • Property disputes, title defects, or ownership fraud.
  • Reliance on any listing, valuation, or loan information on the Platform.

Where liability cannot be entirely excluded by law, our total aggregate liability to you for any claim arising out of or relating to these Terms or the Platform shall not exceed the amount of any subscription or service fee you have paid to Marinsh in the twelve (12) months immediately preceding the event giving rise to the claim, or PKR 10,000 — whichever is lesser.

13. Indemnification

You agree to indemnify, defend, and hold harmless Marinsh Technologies (Private) Limited and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses — including reasonable legal fees — arising out of or in any way connected with: (a) your access to or use of the Platform; (b) your violation of these Terms; (c) any content you submit; or (d) your violation of any applicable law.

14. Governing Law & Jurisdiction

These Terms and any dispute arising in connection with them shall be governed by and construed in accordance with the laws of the Islamic Republic of Pakistan.

You irrevocably submit to the exclusive jurisdiction of the courts located in Islamabad, Pakistan for the resolution of any dispute arising from or relating to these Terms or the Platform, subject to the dispute resolution clause below.

15. Dispute Resolution

Before initiating any formal legal proceedings, both parties agree to attempt to resolve any dispute informally by contacting Marinsh at legal@marinsh.com with a written description of the dispute. We will endeavour to respond within 15 business days.

If the dispute is not resolved informally within 30 days, either party may refer the matter to arbitration under the Arbitration Act 1940 of Pakistan, with arbitration to be conducted in Islamabad in the English language. Each party shall bear its own costs unless the arbitrator orders otherwise.

Nothing in this clause prevents either party from seeking urgent injunctive or other equitable relief from a competent court.

16. Modifications

Marinsh reserves the right to amend these Terms at any time. We will notify registered users of material changes by email or by a prominent notice on the Platform at least 14 days before the changes take effect. Your continued use of the Platform after the effective date constitutes your acceptance of the revised Terms.

We also reserve the right to modify, suspend, or discontinue the Platform (or any part thereof) at any time, with or without notice, and without liability to you.
